Privacy Policy and Instant-Ex Fast Exchange.
1 GENERAL INFORMATION
1.1. In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data ("GDPR") and repealing Directive 95/46/EC, the controller of the personal data of the Users of the Instant-Ex Fast Exchange application is Instant-Ex spółka z ograniczoną odpowiedzialnością with its registered office in Kraków (ul. 1.2. Instant-Ex Fast Exchange performs the functions of obtaining information about users and their behavior in the following manner:
1.2.1. through information entered voluntarily in forms,
1.2.2. through cookies saved in end devices,
1.2.3. through the collection of www server logs by the hosting operator Instant-Ex sp. z o.o., operating in the Instant-Ex Fast Exchange application.
1.3. Instant-Ex Fast Exchange has not appointed a Data Protection Officer.
1.4. The Services offered by Instant-Ex Fast Exchange may only be used after reading this Privacy Policy and the Instant-Ex Fast Exchange Regulations. All capitalized terms, unless otherwise defined in this document, have the meaning given to them in the Instant-Ex Fast Exchange Regulations. This Privacy Policy constitutes an integral part of the Instant-Ex Fast Exchange Regulations
2. Information on Processed Personal Data
2.1. Instant-Ex Fast Exchange collects information provided voluntarily by the User during Registration, use of Instant-Ex Fast Exchange application services, in correspondence and statements addressed to Instant-Ex Fast Exchange, except for cases where such an obligation results from applicable legal regulations.
2.2. To achieve the purposes specified in point 3, Instant-Ex Fast Exchange may process in particular the following data: first names, last names, PESEL number, NIP, REGON, e-mail address, User name, password to the User Account, address of residence, country of residence, bank account numbers, ID number, IP address.
2.2.1. Providing personal data is voluntary, but it is a condition for concluding an agreement and meeting the requirements resulting from legal regulations. Failure to provide this personal data will result in the inability to conclude an agreement and fulfill the obligations to which Instant-Ex Fast Exchange is subject. Data for marketing purposes are provided voluntarily.
3. Data Processing Purposes
3.1.1. implementation of services provided via the Instant-Ex Fast Exchange application, in accordance with the Personal Data Protection Act and the GDPR (Article 6, paragraph 1, letter b of the GDPR, Article 6, paragraph 1, letter a of the GDPR),
3.1.2. implementation of the provisions of the Act on Counteracting Money Laundering (Article 6, paragraph 1, letter c of the GDPR),
3.1.3. providing Users with information related to the use of the Service (Article 6, paragraph 1, letter b of the GDPR, Article 6, paragraph 1, letter a of the GDPR),
3.1.4. communication between Users and Instant-Ex Fast Exchange (Article 6, paragraph 1, letter b of the GDPR, Article 6, paragraph 1, letter a of the GDPR),
3.1.5. preparation and delivery to the User of documents confirming the purchase/sale of currencies (Article 6, paragraph 1, letter b of the GDPR, Article 6, paragraph 1, letter c of the GDPR),
3.1.6. consideration of complaints (Article 6, paragraph 1, letter b of the GDPR, Article 6, paragraph 1, letter a of the GDPR),
3.1.7. accounting (Article 6, paragraph 1, letter b of the GDPR, Article 6, paragraph 1, letter c of the GDPR),
3.1.8. verification of the User in terms of meeting the requirements specified in the Regulations and legal provisions (Article 6, paragraph 1, letter c of the GDPR),
3.1.9. pursuing and defending against any claims related to the concluded agreement or its failure to conclude (Article 6, paragraph 1, letter b of the GDPR).
4. PERSONAL DATA STORAGE PERIOD
4.1. Personal data will be stored for the duration of the contract concluded between the User and Instant-Ex Fast Exchange, and after termination of the contract for the period necessary to secure the pursuit of potential claims and fulfill the obligations arising from the provisions of the law, and in the event of withdrawal of consent to the processing of personal data or submission of an objection - until the withdrawal of consent or submission of an objection, respectively. In a situation where the processing of personal data takes place on the basis of the provisions of the law, the data will be stored for the period resulting from the special provisions..
5. USER RIGHTS REGARDING PERSONAL DATA
5.1. The User has the right to request from Instant-Ex Fast Exchange access to their personal data (Article 15 of the GDPR), their rectification (Article 16 of the GDPR), deletion of data (Article 17 of the GDPR), restriction of data processing (Article 18 of the GDPR), objection to processing (Article 21 of the GDPR), as well as the right to transfer data (Article 20 of the GDPR).
5.2. In cases where data processing is based on consent (Article 6, paragraph a of the GDPR), you have the right to withdraw consent at any time. Withdrawal of consent does not affect the lawfulness of data processing carried out before its withdrawal.
5.2.1. The User has the right to lodge complaints with the supervisory authority competent for personal data protection.
4. 6. DATA SHARING
6.1. Data is subject to disclosure to external entities only within the limits permitted by law.
6.2. The Operator may be required to provide information collected by the Service to authorized bodies on the basis of lawful requests to the extent resulting from the request.
6.3. In connection with the processing of data for the purposes indicated in point 3, data may be transferred to other entities authorized to receive personal data on the basis of appropriate legal provisions, entities performing on behalf of and for the benefit of Instant-Ex Fast Exchange intermediation in actual activities related to the implementation of contracts or obligations provided for by law, as well as other entities providing services on behalf of and/or for the benefit of Instant-Ex Fast Exchange, such as accounting, legal, hosting services. 7. COOKIE INFORMATION
7.1. The Instant-Ex Fast Exchange application uses cookies.
